California tobacco and vapor compliance

California taxes tobacco products at more than half of wholesale cost, bans flavored tobacco statewide and requires every covered product to be on the Unflavored Tobacco List before it can be sold.

California in brief

California regulates non-cigarette tobacco through three state agencies. The California Department of Tax and Fee Administration (CDTFA) issues licenses under the Cigarette and Tobacco Products Licensing Act and collects two excise taxes. The first is the tobacco products tax, paid by the licensed distributor when products are first distributed in California, at a percentage of wholesale cost that CDTFA resets every July 1. For July 1, 2026 through June 30, 2027 the rate is 51.08 percent. It covers all in-scope products, including nicotine e-cigarettes, and has no premium cigar cap. The second is the California Electronic Cigarette Excise Tax (CECET), 12.5 percent of the retail price of nicotine e-cigarettes, collected by in-state and out-of-state retailers and filed quarterly. Distributors and manufacturers or importers file monthly electronic returns by the 25th, even with no activity. The retailer license fee rose from $265 to $450 per location on July 1, 2026 (AB 573). California bans the retail sale of flavored tobacco products (SB 793, upheld by Proposition 31). Premium cigars (handmade and not mass produced by mechanization, whole-leaf wrapper, hand capped, no filter, tip or non-tobacco mouthpiece, wholesale price of at least $12), looseleaf pipe tobacco and, in limited settings, shisha are exempt. The Attorney General's Unflavored Tobacco List (UTL), which the statute required to be published beginning on or before December 31, 2025, now controls sales: any covered product that is not on it is treated as flavored and may not be sold. Manufacturers and importers apply at $300 per brand style and renew each April 1 to 15. Cities and counties may add their own licenses and stricter flavor bans.

Excise taxes

Rates, what they apply to and who pays them.

Tobacco products tax (Proposition 99, 10 and 56 surtaxes combined)

Rate
51.08% of wholesale cost for July 1, 2026 through June 30, 2027 (54.27% for FY 2025-26; 52.92% for FY 2024-25)
Base
Distributor's wholesale cost, meaning the cost charged to the distributor before any discounts or trade allowances (Regulation 4076). For e-cigarettes in arm's-length deals it includes federal excise tax but excludes US domestic transportation.
Who pays
The licensed distributor, at the time the products are distributed in California (first taxable distribution). Products bought from an out-of-state licensed distributor are taxed to the in-state licensed distributor. Consumers who buy untaxed products from out of state owe the tax themselves.
Effective
Rate reset each July 1; current rate effective July 1, 2026

No premium cigar cap or per-cigar maximum. Little cigars moved from the cigarette tax to the tobacco products tax on April 1, 2017. E-cigarettes are tobacco products only when sold with or containing nicotine; devices sold alone or with 0 mg liquid are not taxed. The statutory definition covers products containing, made or derived from tobacco or nicotine, which appears to reach nicotine pouches including non-tobacco nicotine. Credits for products returned by customers in the same period (RTC 30123(c)) and refunds for exported tax-paid products claimed within 3 months after the month of export.

California Electronic Cigarette Excise Tax (CECET)

Rate
12.5% of the retail selling price
Base
Retail selling price of e-cigarettes containing or sold with nicotine, excluding sales and use tax. The CECET is not itself subject to sales tax. Handling charges are included, prorated if the order mixes taxable and nontaxable items.
Who pays
Consumer pays; retailer (including out-of-state delivery sellers) collects at the point of sale, shows it separately on the receipt and remits it. Retailer keeps a 1% reimbursement.
Effective
July 1, 2022; CDTFA rate table shows 12.5% still in effect as of September 2026 (no 2025 or 2026 change found)

Applies in addition to the tobacco products tax paid by the distributor and in addition to sales and use tax. Must be included in advertised prices.

Rolling applications thereafter; AG responds within 90 days of a complete application. Renewal window April 1 to 15 each year for brand styles listed as of March 31, or removal effective on or after June 30. Minor updates within 15 days of the change.

Attorney General list of covered tobacco products (brand styles) certified as having no characterizing flavor. Any covered product not on the UTL is deemed flavored and may not be sold by retailers, wholesalers, distributors or delivery sellers. Applicants are manufacturers or importers; each brand style needs a product form, packaging images, certification under penalty of perjury and a sample. E-cigarettes and other products under FDA authority must have FDA marketing authorization or a qualifying pending application (for tobacco-derived nicotine products on the market on August 8, 2016 with a PMTA filed by September 9, 2020; parallel rule for non-tobacco nicotine products on the market April 14, 2022). Exempt from listing: premium cigars (handmade and not mass produced by use of mechanization, whole-leaf wrapper, capped by hand, wholesale price of at least $12, no filter, tip or non-tobacco mouthpiece), looseleaf pipe tobacco and shisha. RYO is not exempt. Handmade cigars under $12 wholesale are not exempt.

Where filers get caught in California

The problems we see most often, and the penalties behind them.

Not on the UTL means treated as flavored

Any covered product that is not on the Attorney General's Unflavored Tobacco List, which the statute required to be published beginning on or before December 31, 2025, is treated as flavored and cannot be sold. Retailers face $50 per package seized, suspension on a second seizure and revocation on a third, and AB 573 extended enforcement to wholesalers and distributors.

The premium cigar exemption is narrow

A cigar is exempt from the flavor ban and the UTL only if it is handmade and not mass produced by mechanization, has a whole-leaf wrapper, is capped by hand, has no filter, tip or non-tobacco mouthpiece, and sells for at least $12 wholesale. Handmade cigars below $12 must be listed.

Listing errors are common

UTL submissions require exact brand style, variant and package details. Self-filed listings often need corrections, and every error leaves product at risk of seizure at the retailer.

Zero returns and no proration

Monthly returns are due the 25th even with no activity. License fees are not prorated, and distributor and wholesaler licenses all lapse December 31.

Local rules stack on top of the state

State law does not preempt local tobacco rules. Some cities and counties require their own retail license or ban flavors with no premium cigar exemption, such as Sacramento.
