Illinois tobacco, vapor and nicotine pouch compliance

Illinois taxes cigars, pipe tobacco, smokeless tobacco, e-cigarettes and nicotine pouches at 45 percent of the wholesale price, paid by the last distributor before the retailer or consumer. Distributors file monthly in MyTax Illinois, retailers need a license for each location, and Cook County and Chicago add their own taxes and licenses.

Illinois in brief

Illinois taxes every in-scope product except little cigars under the Tobacco Products Tax Act of 1995 (35 ILCS 143). Since July 1, 2025 (Public Act 104-0006) the rate is a flat 45 percent of the wholesale price for cigars, pipe tobacco, roll-your-own, smokeless tobacco, moist snuff, electronic cigarettes and, for the first time, nicotine pouches, lozenges and gum. Before that date the rates were 36 percent for tobacco products, 15 percent for electronic cigarettes and 30 cents per ounce for moist snuff. There is no premium cigar cap through December 31, 2026. Public Act 104-468 (effective June 16, 2026) changes the tax from January 1, 2027: the 45 percent is measured by the actual cost paid by the distributor or remote retail seller, the tax on each cigar (other than little cigars) may not exceed $0.75 through December 31, 2029, and out-of-state remote retail sellers of cigars, pipe tobacco and alternative nicotine products to Illinois consumers must be licensed once their Illinois gross receipts reach $100,000. Little cigars (filtered rolls under 4 pounds per thousand) are taxed as cigarettes at 149 mills per stick and are stamped when packed in 20s or 25s. The tax is paid by the last distributor who sells to an Illinois retailer or consumer, and a retailer that buys from an unlicensed supplier must itself register as a distributor. Distributors file Form TP-1 with the TP-1-IL transaction schedule by the 15th of each month, and since January 1, 2026 paper filing is no longer allowed. Every retail location needs a Cigarette and Tobacco Products Retailer License, and the fee doubled to $150 per location on July 1, 2025. Shippers of tobacco products to unlicensed Illinois buyers file a monthly state PACT Act report (PA-2) by the 10th. Cook County adds its own per-unit and per-milliliter taxes, and Chicago adds a liquid nicotine tax and a city tobacco license.

Where filers get caught in Illinois

The problems we see most often, and the penalties behind them.

Using the old e-cigarette rate

The e-cigarette rate rose from 15 percent to 45 percent of wholesale on July 1, 2025. IDOR's own e-cigarette FAQ still shows 15 percent, so check the bulletin and rate table before pricing or filing.

Forgetting nicotine pouches

Nicotine pouches, lozenges and gum became taxable tobacco products on July 1, 2025. Distributors who did not add them to TP-1-IL are underreporting.

Buying from an unlicensed supplier

A retailer that buys tobacco products or e-cigarettes from a supplier that is not an Illinois licensed distributor must register as a distributor, post a bond unless a statutory exemption applies, and file TP-1 itself.

Treating little cigars as cigars

Filtered little cigars under 4 pounds per thousand are taxed as cigarettes, need a cigarette distributor license and stamps for 20 and 25 packs, and other pack sizes go on Form RC-55, not TP-1.

Paper returns and late filing

Since January 1, 2026 IDOR no longer allows paper TP-1 filings. A late return costs the lesser of $250 or 2 percent of the tax, and late payment penalties rise from 2 percent to 10 percent after 30 days.

Missing the January 1, 2027 changes

P.A. 104-468 moves the tax base to actual cost, caps the tax at $0.75 per cigar (not little cigars) through December 31, 2029, and requires out-of-state remote retail sellers above $100,000 of Illinois gross receipts to be licensed. Pricing, invoicing and TP-1 reporting set up for 2026 will need to change.

Penalties

Penalty

Late filing: lesser of $250 or 2% of tax required to be shown; after a nonfiling notice, an additional penalty of the greater of $250 or 2% of tax, up to $5,000.
