New Hampshire tobacco and vapor compliance

New Hampshire taxes cigars, pipe tobacco, smokeless and other nicotine products at 65.03% of the wholesale price, while premium cigars that meet the statutory test are exempt. Wholesalers pay the tax and file with the Department of Revenue Administration, and since July 1, 2025 every manufacturer, wholesaler and retailer also needs a Liquor Commission tobacco license.

Checked against New Hampshire statutes, regulations and agency guidance on September 28, 2026. Cigarettes are outside our scope and are covered here only where their rules reach other products.

New Hampshire in brief

New Hampshire has no general sales tax, but it taxes tobacco products under RSA ch. 78, administered by the Department of Revenue Administration (DRA). Tobacco products other than cigarettes (cigars, pipe tobacco, smokeless, wraps and other products containing or derived from tobacco or nicotine) are taxed at 65.03% of the wholesale sales price, with no per-cigar cap. Premium cigars (made entirely by hand of all natural tobacco leaf, hand constructed and hand wrapped, weighing more than 3 pounds per 1,000, and kept in a humidor) are excluded from the definition of tobacco products and are not taxed, effective January 1, 2020. Little cigars and roll-your-own are treated as cigarettes: little cigars pay $1.78 per 20 with NH stamps, and RYO is taxed at the cigarette rate with 0.09 ounce counting as one cigarette. E-cigarettes are taxed at $0.30 per milliliter for closed cartridges and 8% of the wholesale sales price for open containers. The tax is paid by the wholesaler that ships or transports tobacco products to NH retailers; wholesalers file Form DP-151 with DRA by the 15th day after each monthly period (quarterly by DRA permission for small filers). Since July 1, 2025 (SB 80, 2025 ch. 224) manufacturers and wholesalers need both a DRA tobacco tax certificate ($100 manufacturer, $250 wholesaler, expiring June 30 of even-numbered years) and a Liquor Commission license ($100 manufacturer, $250 wholesaler, annual), plus Secretary of State registration; retailers need a Liquor Commission retail tobacco license ($216 to $648 by register count). Retailers must buy only from licensed wholesalers and may not hold product without documentation that NH tax was paid. No statewide flavor restriction was found. SB 524 (2026 ch. 259) adds statutory inventory and sales reporting to the Liquor Commission for manufacturers, wholesalers and retailers effective January 1, 2027.

License: annual. Certificate: every two years by June 30 of even-numbered years; renewal only if in good standing with DRA (no delinquent taxes, fees or penalties).

A wholesaler is any person receiving, storing, purchasing and selling tobacco products from any source for distribution to persons other than consumers. No wholesaler may sell or distribute tobacco products in NH unless registered with the Secretary of State, licensed by the Liquor Commission and holding a DRA tobacco tax certificate; a separate license and certificate is required for each location. License and certificate must be displayed and are not transferable; notify DRA and the Commission and surrender them within 30 days of ceasing business. DRA may deny a certificate for recent tobacco tax, theft or fraud convictions or lack of financial responsibility. Liquor Commission rules (emergency rules effective February 25 to August 2026) required Form LTA-4T and Form LTW-17, training for new licensees, and an office on the premises where receiving and shipping records are kept. Premium cigars are not 'tobacco products', so a seller of only premium cigars appears to fall outside this license (see open questions).

Effective
Rate and structure in current RSA 78:2, II as recodified by 2019 ch. 178, effective January 1, 2020

No per-cigar cap. Where filers get caught in New Hampshire

The problems we see most often, and the penalties behind them.

Assuming every handmade cigar is premium

The exemption requires all four elements, including storage in a humidor. Cigars that are machine bunched, weigh 3 pounds or less per 1,000, or are not kept in a humidor are taxed at 65.03% of wholesale.

Two credentials, two agencies

Since July 1, 2025 a wholesaler or manufacturer needs both a Liquor Commission license and a DRA tobacco tax certificate, plus Secretary of State registration, and a wholesaler needs a separate license and certificate for each location. The license renews every year; the certificate expires June 30 of even-numbered years.

Little cigars and RYO are cigarettes

Little cigars need NH stamps at $1.78 per 20 and RYO is taxed per 0.09 ounce at the cigarette rate. Both must also be in the Attorney General's tobacco directory.

Retailers buying from unlicensed suppliers

Retailers must buy only from NH licensed wholesalers and keep 24 months of invoices on site showing NH tax paid. Product without that documentation is contraband, and buying it draws fines of $500 to $5,000.

New reporting to the Liquor Commission

Emergency rules in effect February to August 2026 required monthly inventory and sales reports from wholesalers and manufacturers and quarterly reports from retailers, and a statutory reporting mandate starts January 1, 2027. Watch for the final Liquor Commission rules and forms.
