New Jersey tobacco and vapor compliance

New Jersey taxes cigars, pipe tobacco, smokeless, and other nicotine products at 30% of the wholesale price, with separate rates for moist snuff and vapor liquids. Distributors register with the Division of Taxation and file a monthly return by the 20th, and retail vape shops need their own license and monthly return.

Checked against New Jersey statutes, regulations and agency guidance on September 23, 2026. Cigarettes are outside our scope and are covered here only where their rules reach other products.

New Jersey in brief

New Jersey taxes every non-cigarette tobacco and nicotine product under the Tobacco and Vapor Products Tax Act (N.J.S.A. 54:40B). Cigars, little cigars, pipe tobacco, roll-your-own, chew, and other nicotine products are taxed at 30% of the wholesale price, with no cap for premium cigars. Moist snuff is taxed at $0.75 per ounce. Liquid nicotine sold by distributors and wholesalers is taxed at $0.30 per milliliter, and container e-liquid (refill bottles) is taxed at 30% of the listed retail price, collected by the retail seller. Both vapor rates tripled on August 1, 2025 under P.L. 2025, c.68. The tax is paid by the distributor (whoever brings product into New Jersey or makes it here) or wholesaler; if they do not pay, the retail dealer or consumer owes compensating use tax. Distributors and wholesalers must hold a free Tobacco and Nicotine Products Certificate of Authority for each place of business (Form TPT-R) and may be required to post security. Monthly Form TPT-10 returns with schedules are due the 20th of the following month. Retail stores that sell container e-liquid must hold a $50 per location Vapor Business License, renewed each year by March 1 for the April 1 to March 31 term, and file Form VB-100 monthly even with no activity. Flavored vapor products (including menthol) have been banned statewide since April 20, 2020. A 2026 bill (S4012) would raise the tobacco products rate to 50%, double the moist snuff rate, and name nicotine pouches expressly; it is not law yet.

Required of distributors and wholesalers. A distributor is anyone selling tobacco products in NJ who brings them in from outside the state, manufactures them in NJ, ships them to NJ persons for retail sale, or receives them without proof tax was paid. Out-of-state sellers who ship to NJ retailers fit the distributor definition. The Division's 2018 notice says a separate certificate is required for each place of business and that any business selling tobacco or nicotine products (other than cigarettes) not already registered must obtain one; the registration form itself addresses distributors and wholesalers. Apply with Form TPT-R by mail to PO Box 187, Trenton, NJ 08695-0187.

No cap or exemption for premium cigars. 'Tobacco products' covers products containing, made, or derived from tobacco or nicotine for consumption, including cigars, little cigars, cigarillos, chewing and pipe tobacco, smoking tobacco, dry and moist snuff, and substitutes; cigarettes are excluded. Nicotine pouches appear to fall within this definition as nicotine-derived products, but no Division page or form names pouches expressly (see open questions). Sellers pass the tax to customers and give an invoice showing tax paid.

Shipping to consumers

Rules for online and other remote sales delivered to consumers.

Shipping rule

No New Jersey statute found that licenses or bans delivery sales of cigars, pipe tobacco, smokeless, vapor, or pouches to consumers. Age 21 applies to any sale. An out-of-state seller shipping untaxed product into NJ can meet the distributor definition, and a consumer who receives product without NJ tax owes compensating use tax. Federal PACT Act rules (not NJ law) apply to cigarettes, smokeless, and vapor.

Local rules

Local rule

Municipal courts and local health agencies enforce the state age 21 and flavored vapor bans and collect penalties. No local tobacco excise taxes were found. Some municipalities may also require their own retail licenses; check the local code for each store location.

Records and audits

Records

Suppliers include the tax in the sale and give the retailer or consumer an invoice, receipt, or memorandum stating the tax has been paid; enforcement relies on examining purchase and sales invoices. Retailers should keep these to avoid owing use tax.

Where filers get caught in New Jersey

The problems we see most often, and the penalties behind them.

Using the old vapor rates

Liquid nicotine went from $0.10 to $0.30 per milliliter and container e-liquid from 10% to 30% of retail on August 1, 2025. Returns for August 2025 and later must use the current TPT-10 form version.

Skipping a no-sales VB-100

The Division requires vapor businesses to file Form VB-100 every month even when there is no activity. A late return can draw a $100 per month penalty plus 5% per month of tax due up to 25%.

Buying from an unregistered supplier

If the distributor or wholesaler does not pay the tax, the retail dealer or consumer owes compensating use tax directly to the Division. Keep invoices that show New Jersey tobacco tax was paid.

One certificate for many locations

Both the Tobacco and Nicotine Products Certificate of Authority and the Vapor Business License are issued per place of business. Each added location, including a temporary one for a vapor business, needs its own.

Missing the March 1 vapor license renewal

The Vapor Business License runs April 1 to March 31 and must be renewed by March 1. Container e-liquid cannot be sold at retail without a current license.

Penalties

Penalty

Late filing: up to $100 per month or part of a month the return is late, plus a late filing penalty of 5% per month of tax due up to 25%. Interest at prime plus 3%, compounded annually. An 11% cost recovery fee is added if referred to collections.

Publication ANJ-1 (State Uniform Tax Procedure Law, N.J.S.A. 54:49) Source

Penalty

Evasion of the Tobacco and Vapor Products Tax Act carries criminal penalties similar to the Cigarette Tax Act; vehicles and currency connected to illegal possession or transport may be seized and forfeited, and untaxed container e-liquid and tobacco products may be seized.

Security posted under the bond requirement may be applied by the Director to unpaid tax, interest, or penalties without notice.
