State guide

New York tobacco and vapor compliance

New York taxes cigars, pipe tobacco, chew, and since September 1, 2026 nicotine pouches at 75% of the wholesale price, with per-stick and per-ounce rates for little cigars and snuff. Distributors that bring product into the state register with the Department of Taxation and Finance and file monthly by the 20th, and sales into New York City add a city wholesale license, city tax, and city retail rules.

Checked against New York statutes, regulations and agency guidance on September 28, 2026. Cigarettes are outside our scope and are covered here only where their rules reach other products.

New York in brief

New York taxes cigars, pipe tobacco, roll-your-own, chewing tobacco, and (from September 1, 2026) alternative nicotine products such as nicotine pouches under the tobacco products tax in Tax Law Article 20 at 75% of the wholesale price, with no cap or exemption for premium cigars. Little cigars are taxed per stick at $0.2675 each, the same per-stick amount as the $5.35 cigarette pack rate, and snuff is taxed at $2.00 per ounce, with containers under one ounce taxed at $2.00 each. The tax is paid by the distributor: whoever imports tobacco products into New York for sale (above small thresholds) or manufactures them in the state, plus any out-of-state seller the Department of Taxation and Finance appoints to report and pay tax on products it ships into New York. Wholesale and retail dealers are liable for tax on any product in their possession on which no distributor paid it. Appointment as a distributor and the tobacco products wholesale dealer license are both free (Form MT-202), but require sales tax registration, fingerprinting, background questionnaires, and a lease or deed for commercial space; wholesale dealers need a separate, secure warehouse. Distributors file Form MT-203 monthly by the 20th, even with no sales. Every retail location needs a $300 state retail dealer registration renewed each year between September 1 and 20. Vapor products carry a 20% supplemental sales tax collected at retail by registered vapor products dealers ($300 per location, including online locations). Flavored nicotine vapor products are banned statewide, and shipping nicotine vapor products (and cigarettes) to consumers is prohibited; no statewide flavored cigar restriction was found. New York City adds its own layer: a per-unit NYC Other Tobacco Products tax paid by NYC-licensed wholesale dealers ($600 per year license, monthly Form OTP-R), a DCWP Tobacco Retail Dealer license with community district caps, a ban on flavored tobacco products other than menthol, mint, and wintergreen, and minimum prices and pack sizes, including an $8.00 floor for a single cigar.

No fee
Bond
Discretionary: the Commissioner may require a surety bond or other acceptable security in an amount the Commissioner sets as a condition of appointment (Tax Law 472(3)). No amount or formula is published.

Renewal

Required if you import or cause to be imported into New York any tobacco products for sale (the statutory distributor definition applies above 50 cigars, 1 pound of tobacco, or 15 units of alternative nicotine products), or manufacture tobacco products in New York. A seller located outside New York that is not an importer or in-state manufacturer may also request appointment so it can file returns and pay the tax on products it sells, ships, or delivers into the state (MT-202 line 19). DTF's MT-203-W instructions add that a wholesale dealer that imports or causes to be imported more than 50 cigars or more than one pound of tobacco for resale must be appointed, unless it buys tax-paid from an appointed distributor. Apply on Form MT-202 (same form as the wholesale dealer license) by mail to NYS Tax Department, TTTB Registration/Bond Unit, W A Harriman Campus, Albany NY 12227. The applicant must be registered for New York sales tax, give a street address for a commercial location (no PO box), and per the MT-202-C checklist supply a lease or deed to commercial space where day to day business is conducted, organizational documents (foreign corporations also the New York Application for Authority), proof of workers' compensation and disability coverage or a CE-200 exemption, Form CG-100-P personal questionnaires with photos for each controlling person, and a fingerprinting receipt. Out-of-state importers of foreign product may also need a federal TTB permit.

Apply on Form MT-202. Unlike an appointment-only applicant, a wholesale dealer applicant must provide a deed or a lease of at least two years to a separate and secure warehousing facility (a warehouse or commercial building, not an enclosure in a larger facility or a vehicle). Distributors and wholesale dealers may not sell tobacco products to a retail dealer that is not registered or whose registration is suspended or revoked. A holder of this license is also the prerequisite for the NYC wholesale license needed to sell to New York City retailers.

It is unlawful for anyone in the business of selling cigarettes or nicotine vapor products to ship them to any person in New York other than a licensed cigarette agent, wholesale dealer, or registered retail dealer, an export or customs bonded warehouse, or a government officer or agent. Violations are a class A misdemeanor (class E felony for repeat), with civil penalties of the greater of $5,000 per violation or $100 per pack or per vapor product. The statute does not mention cigars, other tobacco products, or alternative nicotine products.

Where filers get caught in New York

The problems we see most often, and the penalties behind them.

Assuming a small cigar is a little cigar

In New York any cigar with a natural leaf wrapper is taxed at 75% of wholesale, however light. Only cigars wrapped in non-natural-leaf tobacco (such as homogenized leaf) that weigh 4 pounds or less per 1,000 or have a filter are little cigars taxed at $0.2675 each.

Selling to New York City retailers on a state license alone

Since June 1, 2018 anyone selling tobacco products to NYC retail dealers for resale needs a $600 per year NYC Wholesale Tobacco Products License and must file monthly OTP-R returns. NYC retailers may buy only from holders of that license, and only a state-licensed wholesale dealer or eligible manufacturer can get it.

Skipping no-activity MT-203 returns

Distributors must file MT-203 every month even with no sales, and attach MT-203-ATT marked no reportable activity if no RYO. Failure to file can lead to revocation, and late tax draws a 10% first-month penalty rising to 30%.

Treating 'no fee' as 'no paperwork'

The free MT-202 application still requires active New York sales tax registration, a lease or deed for commercial space (a separate secure warehouse with a two-year lease for wholesale dealers), personal questionnaires, photos, and fingerprints for controlling persons.

Shipping flavored cigars into New York City

There is no statewide flavored cigar ban, but New York City bans the sale of flavored tobacco products other than menthol, mint, and wintergreen. Brands selling statewide need a separate assortment for city accounts.

Penalties

Penalty

Late MT-203 payment: 10% of tax due for the first month plus 1% for each later month, up to 30%; if a return is more than 60 days late, the minimum penalty is the lesser of $100 or 100% of the tax. Interest compounds daily. Returned payments carry a $50 fee.

Penalty

Selling tobacco products at retail without a state registration: $5,000 to $25,000 for a first violation and $10,000 to $35,000 for a later violation within 3 years; vending machines $750 to $2,000 and $2,000 to $6,000.
